Congressional Legislation News
Congress just passed a Court Security bill. See attached. Among other things, it increases the maximum for voluntary manslaughter from 10 to 15 years, and the maximum for involuntary manslaughter from 6 to 8 years.

Senator Kyl pushed hard for an increase to 20 years for voluntary manslaughter and an increase to 10 years for involuntary manslaughter. We opposed any increase with the attached letter dated 11/13/07, which was prepared with input from Defenders in Arizona, New Mexico, South Dakota and Nebraska. This was the unfortunate but slightly better compromise.

Note that there is no directive to the USSC to increase guideline penalties.

Our letter contains good disparity arguments you can use against above-guideline sentences or in support of below-guideline sentences.
